SECTION 1. INTRODUCTION AND SCOPE

SizeMyTrade LLC ("SizeMyTrade," "we," "us," or "our") operates a web-based trade-planning calculator available through sizemytrade.io and related pages, accounts, downloads, and services (collectively, the "Platform"). The Platform includes a free Core Tool and paid subscription features.

This Privacy Policy explains what personal information we collect, how and why we use it, the parties with whom we disclose it, how long we retain it, and the privacy rights that may be available to you. It applies to visitors, registered users, subscribers, and people who contact us. It does not apply to third-party websites or services governed by their own privacy notices.

The Platform is operated from Florida, United States, but may be accessed internationally. Privacy rights differ by location. Where applicable law gives you rights beyond those described here, we will honor those rights as required.

This Policy is a notice and does not treat ordinary use of the Platform as consent where applicable law requires separate consent. We request consent separately when required, including for certain cookies and marketing communications.

SECTION 2. WHO CONTROLS YOUR INFORMATION

SizeMyTrade LLC determines why and how personal information collected through the Platform is used and generally acts as the data controller, business, or other responsible organization under applicable privacy law.

The Platform is built and hosted using services provided by Wix.com Ltd. and its affiliates ("Wix"). For information Wix processes on our instructions to host and operate our site, Wix generally acts as our service provider or data processor. Wix may act as an independent controller for limited processing for which Wix independently determines the purposes and means, such as certain security, fraud-prevention, legal-compliance, payment, and platform-administration activities. Wix’s practices are described at wix.com/about/privacy and in Wix’s Data Processing Agreement.

SECTION 3. PERSONAL INFORMATION WE COLLECT

3.1 Information You Provide

Account information: name, email address, login credentials or authentication information, subscription tier, and account status.
Payment and transaction information: billing name and address, payment method type, transaction amount, date, payment status, subscription status, and payment reference. Payment card numbers and security codes are processed by Wix Payments and its payment partners; SizeMyTrade does not receive or store complete card numbers or CVVs.
Communications: support requests, feedback, correspondence, and information you choose to include when contacting us.
Marketing preferences: whether you agreed to receive promotional messages and whether you unsubscribed.

3.2 Calculator Inputs and Trade Plans

IMPORTANT LOCAL-PROCESSING DISCLOSURE

The Platform is designed so that calculator inputs—including tickers, prices, stops, position sizes, entries, exits, and trade notes—are processed within your browser and are not intentionally transmitted to or stored on SizeMyTrade’s servers. Trade-plan exports are designed to be generated locally on your device. Do not enter information that you do not want processed on your device. This statement does not include account, subscription, technical, security, or support information described elsewhere in this Policy.

3.3 Information Collected Automatically

Device and browser information, such as browser type, operating system, device type, language settings, and screen resolution.
Network and approximate location information, such as IP address and general location inferred from the IP address. We do not intentionally collect precise GPS location.
Usage and diagnostic information, such as pages viewed, dates and times of access, referring pages, session activity, feature access, error data, and interactions with the Platform.
Cookie, local-storage, authentication, security, and consent information. See Section 6.

3.4 Information from Service Providers

We may receive account, transaction, fraud-screening, subscription, technical, and support information from Wix, Wix Payments, payment-network participants, and other providers used to operate the Platform. We do not receive complete payment-card credentials.

SECTION 4. HOW WE USE PERSONAL INFORMATION

Provide, maintain, authenticate, and secure the Platform and user accounts.
Process subscriptions, confirm payments, provide receipts, and manage access to paid features.
Deliver the Pattern Performance Tracker to qualifying annual subscribers and administer its license.
Respond to requests, provide customer support, and communicate service or account information.
Understand usage, diagnose errors, improve performance, and develop or evaluate Platform features.
Detect, investigate, and prevent fraud, misuse, security incidents, and violations of our Terms.
Comply with tax, accounting, legal, regulatory, sanctions, and recordkeeping obligations; establish, exercise, or defend legal claims.
Send marketing communications where permitted and subject to your right to unsubscribe.

SECTION 5. LEGAL BASES FOR PROCESSING

Where a legal basis is required under the GDPR, UK GDPR, or similar law, we rely on one or more of the following:

Contract: processing necessary to register accounts, provide requested features, process subscriptions, and fulfill our Terms.
Legitimate interests: securing and improving the Platform, preventing fraud, supporting users, administering our business, and understanding service usage, balanced against your rights.
Consent: nonessential cookies or marketing where applicable law requires consent. You may withdraw consent at any time without affecting earlier lawful processing.
Legal obligations and claims: complying with applicable law and protecting legal rights.

SECTION 6. COOKIES AND SIMILAR TECHNOLOGIES

SizeMyTrade and Wix use cookies, local storage, pixels, and similar technologies. These technologies may be used for:

Essential functions, including security, fraud prevention, authentication, account access, payment processing, load balancing, and remembering consent choices.
Functional preferences, including remembering settings selected by a visitor.
Analytics and performance, including measuring traffic and understanding how the Platform is used, where enabled and permitted.
Marketing, if SizeMyTrade enables marketing technologies in the future and obtains any consent required by law.

Where required, our cookie banner allows you to accept, reject, or customize nonessential cookies before they are used. Essential cookies cannot be disabled through the banner because they are necessary for security or service operation. You may revisit your choices through the Cookie Settings link on the Platform. Browser controls may also delete or block cookies, but doing so can impair login, payment, or other functions.

Our then-current cookie banner and cookie settings provide additional information about the specific technologies active on the Platform. If we add a new nonessential analytics or advertising service, we will update our disclosures and consent controls as required.

SECTION 7. HOW WE DISCLOSE PERSONAL INFORMATION

We do not sell personal information for money. We do not knowingly disclose personal information for cross-context behavioral advertising or targeted advertising as those terms are defined by applicable U.S. state privacy laws. We may disclose information as follows:

Wix and Wix affiliates: hosting, account management, analytics, security, communications, subscription administration, and Platform operation.
Wix Payments, financial institutions, card networks, and payment partners: payment authorization, processing, fraud prevention, disputes, refunds, and compliance.
Professional advisers and vendors: legal, accounting, tax, security, and technical services, subject to appropriate duties or contractual protections.
Authorities and legal recipients: when reasonably necessary to comply with law, legal process, governmental requests, enforce our Terms, protect rights or safety, or investigate misuse.
Business transactions: in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of the business, subject to applicable law.

If our practices change so that personal information is sold or shared for targeted advertising as defined by applicable law, we will provide any required notice and opt-out mechanism before or when the change takes effect.

SECTION 8. INTERNATIONAL DATA TRANSFERS

SizeMyTrade is based in the United States. Wix and other providers may process information in the United States, Israel, the European Economic Area, the United Kingdom, and other locations where they or their authorized providers operate. Those locations may have privacy laws different from the laws where you live.

Where required, international transfers are supported by legally recognized safeguards, such as adequacy decisions, approved standard contractual clauses, the UK International Data Transfer Addendum or equivalent terms, or another lawful transfer mechanism. Additional information about Wix’s locations and transfer safeguards is available in Wix’s Privacy Policy and Data Processing Agreement.

SECTION 9. DATA RETENTION

Account and subscription information

While the account or subscription is active and generally up to 3 years afterward, unless a longer or shorter period is appropriate.

Transaction and accounting records

For the period reasonably necessary for tax, accounting, payment disputes, fraud prevention, and legal obligations.

Calculator inputs and locally generated trade plans

Not intentionally transmitted to or retained on SizeMyTrade servers as described in Section 3.2.

Support and business communications

Generally up to 3 years after the matter is resolved, or longer when reasonably necessary for legal claims.

Security, technical, cookie, and consent records

For a period appropriate to security, troubleshooting, consent evidence, provider settings, and applicable legal requirements.

Marketing suppression records

As needed to remember and honor an unsubscribe or objection request.

Retention periods are not guarantees that every record will be kept for the maximum period. We may delete or anonymize information earlier when it is no longer needed, and may retain limited records longer where required by law, necessary to establish or defend claims, or preserved in routine backups until overwritten.

SECTION 10. SECURITY AND DATA BREACHES

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information we process. These include Wix-provided HTTPS/TLS transmission protection, platform security controls, access restrictions, and use of payment providers that maintain payment-industry security obligations.

NO SYSTEM IS COMPLETELY SECURE

No internet service, device, or storage system can be guaranteed completely secure. You are responsible for using a strong, unique password, protecting your login credentials, and promptly notifying us of suspected unauthorized account activity.

If a security incident triggers a legal notification obligation, we will notify affected individuals and appropriate authorities in the manner and within the time required by applicable law.

SECTION 11. YOUR PRIVACY RIGHTS AND CHOICES

Depending on where you reside and whether legal applicability thresholds are met, you may have rights to:

Request access to, confirmation of, or a copy of personal information we process about you.
Request correction of inaccurate personal information.
Request deletion of personal information, subject to legal exceptions.
Request restriction of processing or object to processing based on legitimate interests.
Receive certain information in a portable, machine-readable format.
Withdraw consent where processing relies on consent.
Opt out of marketing communications using the unsubscribe link or by contacting us.
Opt out of qualifying sale, sharing, or targeted advertising if such processing occurs and applicable law grants that right.
Appeal a denial of a qualifying privacy request where applicable law provides an appeal right.
Lodge a complaint with an appropriate privacy or data-protection authority, including an EU supervisory authority, the UK Information Commissioner’s Office, or another local regulator.

Submit requests to Support@sizemytrade.io. Please identify the right you wish to exercise and provide information reasonably necessary to locate your records and verify your identity. We may request additional verification, may decline or limit requests where permitted by law, and may retain information necessary to document the request. Authorized agents may submit requests where applicable law permits, subject to verification of authority and identity.

We will respond within the timeframe required by the law applicable to the request. We will not unlawfully discriminate against you for exercising a privacy right.

11.1 California and Other U.S. State Residents

Residents of California and certain other states may have rights to know, access, correct, delete, obtain portability, and opt out of certain sale, sharing, profiling, or targeted advertising. These rights apply only when the relevant statute covers SizeMyTrade and the requested processing. SizeMyTrade does not currently sell personal information for money and does not knowingly use or disclose sensitive personal information for purposes requiring a right to limit under California law.

11.2 European Economic Area, United Kingdom, and Switzerland

Where the GDPR, UK GDPR, or comparable Swiss law applies, SizeMyTrade LLC is the controller for the processing described in this Policy, except where another party is expressly identified as independently responsible. You may exercise the rights listed above and may contact your local supervisory authority. You may also ask us for information concerning applicable international-transfer safeguards. Where appointment of a local representative or data protection officer is legally required, current contact details will be made available through this Policy or the Platform.

11.3 Canada, Australia, Brazil, and Other Jurisdictions

You may have additional rights under local law, including rights to access, correction, deletion, information about disclosures, withdrawal of consent, or complaint. Contact us and we will assess the request under applicable law. For Canadian anti-spam requirements and similar marketing laws, promotional electronic messages will include an unsubscribe method where required.

SECTION 12. CHILDREN’S PRIVACY

The Platform is intended only for adults who are at least 18 years old. It is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that a child provided personal information in violation of this Policy, we will take reasonable steps to delete it. A parent or guardian may contact Support@sizemytrade.io with a concern.

SECTION 13. THIRD-PARTY LINKS AND SERVICES

The Platform may link to or integrate services operated by third parties. Their privacy practices are governed by their own notices, and we are not responsible for their independent practices. Review the privacy terms of a third-party service before providing information to it.

SECTION 14. CHANGES TO THIS PRIVACY POLICY

We may update this Policy to reflect changes in the Platform, providers, law, or business practices. We will post the revised Policy with a new “Last Updated” date. If a change is material, we will provide additional notice by email, account notification, or prominent Platform notice where reasonably appropriate or legally required. We will request renewed consent when applicable law requires it.
